Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PropertyVault platform ("Platform"), operated by PropertyVault Ltd. By accessing or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age and a resident of a supported jurisdiction (Ghana, Kenya, South Africa, or Nigeria) to use the Platform. You must complete Know Your Customer (KYC) verification before making any purchase.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

3. Property Tokens

Property tokens represent fractional ownership rights in real estate assets listed on the Platform. Tokens are issued as ERC-3643 compliant security tokens on the Polygon blockchain. Ownership of tokens is subject to applicable securities regulations in your jurisdiction.

4. Risks

Real estate and digital assets carry inherent risks including but not limited to market volatility, liquidity risk, regulatory risk, and technology risk. Past performance does not guarantee future results. Please review our Risk Disclosure for full details.

5. Limitation of Liability

To the maximum extent permitted by law, PropertyVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

6. Fees, Taxes, and Settlement

You are responsible for reviewing all disclosed fees before placing an order or completing a transaction. You are also responsible for any taxes, duties, or reporting obligations that arise from holding, transferring, or disposing of tokens acquired through the Platform.

7. Restricted Activities

You may not use the Platform for unlawful conduct, sanctions evasion, market manipulation, fraud, identity misrepresentation, or any activity that could compromise the security, integrity, or lawful operation of the Platform.

8. Suspension and Termination

PropertyVault may suspend, restrict, or terminate access to the Platform where required by law, regulation, court order, internal compliance policy, or where we reasonably suspect fraud, sanctions exposure, misuse, or breach of these Terms.

9. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Disputes shall be resolved through binding arbitration.

10. Changes to These Terms

We may update these Terms from time to time to reflect operational, legal, or regulatory changes. The updated version becomes effective when posted on the Platform unless a different effective date is stated.
